Today, Frank Deluca would be 63 and remains free. Where he is may be anyone's guess. There is speculation he may be hiding out somewhere under the United States Federal Witness Protection Program.

Last week's decision was handed down in Buffalo, New York by US Magistrate Judge Jeremiah J. McCarthy. After reviewing the documents, US Magistrate Judge Jeremiah J. McCarthy decided they do not meet the guidelines of what Kuzma requested.

Not willing to give up yet, Kuzma has already filed new Freedom of Information requests about Deluca and Agent Fitzgerald.

Kuzma wants to see the FBI documents they have on Deluca. He feels the documentation may prove Peltier is innocent.

“Who really knows who Deluca is?I think it is somewhat strange he was indicted for the shooting of a FBI agent and yet remains free,”

said Kuzma.

There is speculation that Deluca may have been a plant inside of the American Indian Movement by the FBI to monitor Peltier and others.

“Since Leonard was denied parole, there really is not a whole of legal action going on right now. This is one area that may turn up new evidence to free him,”

stated Kuzma.
